REDUCTION OF COURT FEES ON PROBATE AND HEIRSHIP PETITIONS IN MAHARASHTRA

The Government of Maharashtra has issued notification to the Maharashtra Court Fees Act, 1959 (“the Act”), vide Notification No. Mundrank-2023/C.R.641/M-1(Policy), dated August 9, 2024. This amendment has also been published in the Maharashtra Government Gazette on 9 August 2024. The amendment is summarized below:

Section 46 of the Act empowered the Government to reduce or remit the fees mentioned in the First and Second Schedules of the Act, either wholly or partially, within any territory under its administration by issuing a notification in the Official Gazette.

By exercising this power, the Government of Maharashtra, through this notification, has reduced the maximum limit of fees from 75,000 rupees to 10,000 rupees for widows applying for probate or letters of administration (with or without a will annexed) for property valued above three lakh rupees. This reduced fee applies to also to applications filed in any Civil Court for obtaining an Heirship Certificate.
