MANDATORY DISPLAY OF QR CODE IN PROMOTION/ ADVERTISEMENTS FOR REAL ESTATE PROJECTS

The Maharashtra Regulatory Authority (‘MahaRERA’) which is established under the Real Estate Regulation and Development Act, 2016 (‘Act’), has vide its order dated 29th May 2023 bearing order no. 46/2023 (‘Order’) issued mandatory guidelines to the promoters who have registered their projects with the MahaRERA to display of QR code in promotion/ advertisements for real estate projects.

The key features brought about by this order are as follows:

  • The promoter shall prominently display Quick Response (“QR”) code on each project promotion / advertisement published after 1st August, 2023.
  • The QR code should be published in a method that is legible, readable, and detectable with software application.
  • The QR code must be published besides the MahaRERA Registration Number and the Website Address.

Further, these directions shall apply to all the following, including any other modes or mediums of promotion/advertisement as may be directed by the MahaRERA:

  • Advertisements on Newspaper / Magazines / Journals etc.
  • Printed Flyers / Brochures / Catalogues / Leaflets / Prospectus.
  • Standees on Project Sites / Sales Office.
  • Websites / webpages of Projects.
  • Social Media Advertisements.
  • Any other Advertisements where QR codes can be published.

As per the Act, advertisement means any document which is issued or advertised through any medium (including notice, circular or publicly in any other form) which informs the public regarding real estate projects or inviting the public to purchase any plot etc. or to make deposits in such regards. As per the provisions of the Act, it is obligatory for the promoters to register their real estate projects with the Real Estate Regulatory Authority before advertising or marketing in any manner any plot, apartment, or building. Further it has been inter alia clarified by the MahaRERA that the promoter is also required to mention the Registration number and the particulars of the enterprise. Therefore, to make this process easier for the homebuyers and to assist homebuyers in obtaining transparent information regarding the details of the project in a single scan, this order has been passed as mandatory guidelines / direction. This order shall come into force with effect from the day 1st August, 2023.
